Terms and Conditions: Lanka Lions Gate Travels

The booking terms and conditions of Lanka Lions Gate Travels are detailed as follows. All bookings with Lanka Lions Gate Travels are subject to the below T&C. By making a booking with us, you are agreeing to those T&C.

1) BOOKING AND PAYMENT

If you are making a booking for one or more than one person, the person confirming the booking must have the consent of other accompanying guests to make the booking on their behalf and this person will be responsible for all payments for all guests travelling on the booking. For the purposes of our booking conditions “you” means the individual making the booking and all members of the party travelling with them.

We make every reasonable effort to ensure that any written or oral instructions provided to us are accurately reflected in the documentation we provide to our clients and on which a booking is based. Please check the information we send you to ensure that it is accurate and reflects the instructions you have given us. We cannot be responsible for any errors that may result from an inaccuracy in our documentation that is not notified to us by email within 10 days of it being sent to you and on which you may book your arrangements or amend them.

A booking is accepted only after we receive written confirmation from you by e-mail along with payment of a 30% of the value of the Travel Arrangements. A receipt will be issued once you made the payment.

Full payment or the advance payment of 30% and your written confirmation will indicate as an acceptance of these terms and conditions by you, and is such a contract between Lanka Lions Gate Travels, and you is constituted. That contract and these Booking Terms and Conditions shall be governed in all respects by the laws of Sri Lanka.

The balance payment (if any) due for your Travel Arrangements could be paid any date after the confirmation or at the time you arrive to Sri Lanka. If you unable to settle the full payment for the above said date we may treat the booking as cancelled and relevant cancellation charges will apply.

Final Invoice will be mail to you after you settle the total of your payments as per the Itinerary confirmed by you.

Payment Method – Bank Transfer or by Cash (If you are paying at the time of arrival) 

Note: all additional charges and fees related to this will be borne by you.

2) Rates

Once you have made a booking with Lanka Lions Gate Travels and paid your deposit there will be no change to your price except where the Government of Sri Lanka impose any new taxes on travel and travel suppliers, Exchange rates fluctuation, price increases and such a change is done only if it is greater than 5% of your total arrangements booked with the company

3) Cancellations & Amendments

The cancellation fee will apply from the moment of trip order and the cancellation will apply only after receiving a message in write to us. The following penalties will apply

Between 31-60 days forfeit of deposit.
30 days and less before arriving date 100% from the value of the whole advance deposit.

Any early departure of the trip or hotel or excursion cancellation during the trip due to traveler decision will be his responsibility and no refund will be made.

If the Tour Company /we cancel the tour due to unavoidable circumstances, we will refund back the full deposit to our traveler.

If you wish to make any other change to your tour arrangements at any time after confirmation has been issued, we will meet your request, only so far as is possible. We require your authority in writing before we can make any change. In the event that any change is requested in relation to a group booking we require the authority in writing of the Lead Name before we can make the change.

All refunds will be processed within 2 weeks from the date of cancellation.

4) Insurance

You are strongly recommended to take out personal travel & health insurance, at the time of booking, for all members of your party. It is your responsibility to ensure that the insurance you purchase is adequate. All travelers booking with us need to notify us of their insurance arrangements prior to travelling.

5) Health, Passports and Visas

It is your responsibility to ensure that you and other members of your party obtain the right inoculations and medical advice before you travel and any expense or cost due to physical or mental problem will be on traveler.

The traveling agency is not responsible to damages that may happen due to not arranging the needed visa by the traveler himself, this is traveler responsibility. Passport must be valid for at least 6 months ahead. Any coast that may happen due to in valid passport or visa will be paid by the traveler.

6) Force Major

The travelling agency is not responsible to any change or cancellation in the itinerary at any time that is due to Force Major: weather conditions, riots, fire, floating, war, invasion, emergency situation, or any other act of force major.

7) Local Laws

All travellers are expected to obey the laws and regulations of the country and any failure to do so will relieve Lanka Lions Gate Travels of all obligations that they may otherwise have under these booking conditions.

8) Complaints

All complaints are to be sent via by registered post and or to e-mail us as per the contact details in our website.

Please do not delay in contacting us in the event of a complaint. You must immediately inform your guide or contact us on company phone number. We will do our best to solve your problem as earliest as possible and to provide you a memorable tour.

If your complaint cannot be resolved locally you must follow this up by writing a formal complaint letter to us within 30 days of your return home incorporating all other relevant information.

We are always looking for ways to improve our services and our products and as your feedback may help us a lot to do so.

9) Breakages and Damage

You will be responsible for any breakages, losses or damage caused by you or a member of your party during your stay in the accommodation. It is your responsibility to put right the damage or to make full payment to the supplier before departure and to indemnify us against any losses, damages or claims made against us.

10) Child Policy

All children below age 5 will be free of charge & between ages 6-12 will be on half rate.

11) Responsibility

We will only accept liability for incidents that arise as a direct result of our proven negligence, or that of our suppliers, in respect of arrangements forming part of your holiday itinerary, in cases where all your holiday accommodation and transfers are arranged by us for the entire extent of your stay. This applies to illness, injury and/or death.

NOTE: WE DO NOT ACCEPT LIABILITY FOR THE NEGLIGENCE OF OUR SUPPLIERS IN ACCOMMODATION-ONLY BOOKINGS. IN ALL SUCH CASES WE ACT SOLELY AS A BOOKING AGENT AND ACCOMMODATION IS CHOSEN AT YOUR OWN RISK.

We act only as a co-ordinator in instances where only part of the holiday itinerary is arranged by us for all passengers (including You) with respect to services provided by certain underlying operators, including hotels, lodges, restaurants, road transport providers, professional guides, air charter services, boating, rafting, kayaking, bush walking, trekking and climbing activities. All bookings with us are therefore subject to the limitations of liability imposed by the underlying operators/suppliers involved in Your Travel Arrangements. And Lanka Lions Gate Travels cannot be held responsible for the failure of any component of the holiday for which we do not have direct responsibility. This includes any difficulty in finding hotels if customers choose to book accommodation-only deals and arrange their own transport.

We assume no responsibility for any loss, damage to baggage, property or for injury illness or death or for any damages or claims however so caused arising directly or indirectly from accidents, loss or damage to person or property, delays, transport failures, strikes, war, force majeure, Acts of God etc. or any other loss arising from or pursuant to Your Travel Arrangements.

We accept responsibility for ensuring the holidays which you book with us are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

We work with different operators and service providers for accommodation or other services and facilities which you will be using and changes may occur. On occasion especially during low season, certain facilities may not be open or available due to maintenance, weather conditions, power cuts, and lack of demand or for other reasons. In such circumstances we cannot be held responsible for advertised facilities being unavailable. There may be instances where alternative accommodation or services may need to be provided, in such instances we will ensure this is of a similar or superior standard.

12) Limitations of Liability

Lanka Lions Gate Travels shall not be liable for any direct, indirect, special, incidental or consequential damages arising out of or in any way connected with the use of or inability to use this web site, or the information, products and services obtained through this web site, the submission of any personal information, including, but not limited to, bank and credit card details, the performance or nonperformance of Lanka Lions Gate Travels or any unauthorized access or breach of security into this web site through the internet or otherwise arising, whether based on contract, strict liability, tort (including negligence), product liability or otherwise even if Lanka Lions Gate Travels has been advised of the possibility of such damages.

By making a reservation, you acknowledge that in all events, Lanka Lions Gate Travels shall not be liable for any incidental or consequential damages and that the sole extent of Lanka Lions Gate Travels liability, if any, shall never exceed the amount actually paid by you to Lanka Lions Gate Travels.
